Healthy not High is our stance here at Farmhouse Hemp. Our company has always been committed to creating products for the health benefit of people and pets. We do not have any products for sale that we have added psychoactive cannabinoids to. Yes, our products do have a small amount of THC in them because we do not chemically remove any cannabinoids. We leave all of the cannibinoids intact as it occurs naturally in the hemp flower that we grow. We believe and studies do support that the entourage effect is best when using CBD products. 

The entourage effect is the theory that compounds in cannabis, like cannabinoids (THC, CBD) and terpenes, work together synergistically to create enhanced or different effects than any single compound would alone, potentially boosting therapeutic benefits. 

We reside in Colorado and if you want a product to get you high, well you just go to the dispensary. We do understand that some states do not have this luxury as we do here in Colorado. This lack of state regulated THC products created a huge loophole industry.

What is the Loophole Industry:

Those THC gummies and drinks you see online or at the grocery store, that's the loophole industry.

These companies found a way to create products that will give people a buzz and seized the opportunity to make millions off of it while they could still get away with it. How did they do it?  They isolate all of the THC components from hemp flower and add that intoxicating THC to products such as drinks, gummies, etc. This loop hole industry is the reason why the waters are getting muddy when it comes to hemp derived products.

 

Here's how they found a loophole:

Step One - Legally grown hemp flower has intoxicating THC cannabinoids. Isolate those cannabinoids and add them to products.

The THC these companies are using is derived from legally grown hemp flower. There isn't much Delta 9 THC, Delta 8 THC, or THCA (all cannabinoids that are psychoactive "get you high") in hemp flower but if you have enough flower you can pull a significant amount of THC from acres of hemp flower.

So step number one solved, you just need to grow a fair amount of hemp flower and extract for the THC components. This extraction process of course involves using solvents and isolating these cannabinoids strips a lot of the good qualities from the natural plant. In these products though the end goal is the buzz not anything else.

 

Step Two - Find the flaws in the wording of the 2018 Farm Bill to be able to create intoxicating products.

The second step was finding the loophole in the wording in the Farm Bill of 2018. The 2018 Farm Bill only specifies that products should contain no more than 0.3% Delta 9 THC. With that wording alone many companies just starting using the Delta 8 THC cannabinoid from the hemp flower in all of their products. With Delta 8 and not Delta 9 present in the products, boom there's your "legal" buzz. Some companies figured out that they could easily use the Delta-9 THC cannabinoid that they pulled from the hemp flower due to the the 0.3% threshold. The 0.3% threshold allows for products to contain more than enough THC to be intoxicating when consumed. A drink might have a low percentage relative to the total liquid volume, but a high enough milligram amount of Delta-9 THC per serving to produce a "noticeable buzz" or a full high.

For instance a 12oz drink can contain 5mg, 10mg, or even up to 20mg of Delta-9 THC legally it is still at or under 0.3% of the entire can of liquid.

How the Loophole Industry has harmed full-spectrum CBD companies like ours: After years of trying to educate the public about CBD and the benefits, I have to admit it is a very confusing time for consumers. It's also a very defeating time for our company.

When we saw this trend of hemp derived THC products hitting the market we knew eventually companies such as ours would be hurt by this. Well unfortunately that time is upon us.

 

Remember when the government was shutdown in 2025? To reopen it they had to approve a Government Spending Bill right? Well, Mitch McConnell slipped in a new provision into this Government Funding Bill to change the regulations of hemp. Mind you, he is the same one who championed the industry and fought to get the 2018 Farm Bill approved. There's talk that he was paid off by major players in the alcohol industry to put this language in place.

 

The provision effectively bans intoxicating hemp-derived THC products by closing a "loophole" in the 2018 Farm Bill. The new rule, which becomes effective in November 2026, sets a limit of 0.4 milligrams of total THC per container for final products.

That right there is how it gets us and ALL full spectrum CBD companies! That 0.4mg total per container. This is not a % that we are talking about anymore this is total milligrams of THC that is able to be in an entire bottle. 

 

Take a look at our 500mg full-spectrum drops. You probably only take about 1/2-1 full dropper a day. In a full dropper you are getting 16mg of CBD and around 0.5 mg of THC. In an entire bottle there is (according to our testing) 19mg of THC. There will be no way once these new regulations go into effect that we will be able to sell our products anymore. 

 

In their efforts to close the loophole industry they will effectively close all companies like ours that are focused on Healthy not High.

Contact Your Legislators: Reach out to your U.S. representatives and senators to share your concerns about the impact of the new regulations. You can find their contact information on the official House.gov and Senate.gov websites. Calling is more effective than an email. Share your personal story about how full-spectrum hemp products have helped you or a loved one. Express your support that access to products such as these should remain open. 

Advocate for Alternative Regulation: Many in the industry (including us at Farmhouse Hemp) support a clear regulatory framework, similar to legal marijuana, that includes age verification (e.g., 21 and older limits), third-party lab testing, and state licensing, rather than an outright ban.

Our hope is that the provision is edited or recinded altogether and the states take over the control and enforcement of intoxicating THC products. It comes down to the basic intention of the product. Is the end goal of the product to create an intoxicating effect? If so, then that should be regulated by the state much like alcohol.

 

Full-spectrum CBD products are not intended and/or created to get people high. Our company was built on providing people and pets with CBD Products that are Simple, Honest, and Pure.
